The Township of Wainfleet realizes private encroachments on Township property exist and will continue to be discovered. The Township must ensure that encroachments do not adversely affect these properties or the Township's ability to maintain effective services or restrict public access and enjoyment of land for public use.
An encroachment means anything constructed or erected with a fixed location on the ground or attached to something having a fixed location on the ground that extends on, over or under Township owned lands. Examples include:
- Structural: fences, gates, decks, buildings, septic systems, pools, retaining walls;
- Non-structural: pool drainage, waste dumping;
- Vegetative: gardens, decorative landscaping, trees, shrubs.
The Township has developed an Encroachment Policy to help the Township manage encroachments effectively. Encroachments must be removed unless authorized by a consent letter, encroachment agreement or expressly permitted by the policy.
